PS Liban, KPC MD Joe Sang, EPRA CEO Kiptoo resign as fuel supply probe intensifies

Principal Secretary for Petroleum Mohamed Liban has resigned as probe into the importation of substandard fuel intensifies.

In a press release issued Saturday, Chief of Staff and Head of the Public Service Felix Koskei confirmed that Kenya Pipeline Company (KPC) Managing Director Joe Sang and Energy and Petroleum Regulatory Authority (EPRA) Director General Daniel Kiptoo Bargoria had also stepped down.

The resignations follow the arrest of the three officials by detectives from the Directorate of Criminal Investigations over the alleged importation of substandard fuel in breach of existing supply arrangements.

Koskei said preliminary findings indicate that senior officials tasked with overseeing the petroleum supply chain may have manipulated data on local fuel stocks to create a false impression of an impending shortage.

“The President notes with grave concern that primary duty bearers responsible for administering the petroleum supply chain may have manipulated data on in-country fuel stocks. This appears to have been done to exploit rising global prices and public anxiety, thereby creating a false impression of an impending supply shortfall,” said Koskei.

He revealed that the cargo was sourced outside the Government-to-Government (G2G) fuel supply framework introduced in 2023 and was procured at inflated prices, in violation of established emergency procedures.

“The shipment in question was procured in blatant breach of the G2G framework, at a price significantly above the contracted rates, in complete disregard of established emergency procurement procedures, and was of substandard quality,” Koskei stated.

He warned that the government will take firm action against any individuals found culpable of acts deemed to constitute economic sabotage.

“Petroleum products as the backbone of the economy, and in recognition of the compelling public interest, the matter has been escalated to the relevant investigative agencies for a full and comprehensive inquiry. All governance actors within the sector are required to provide full access to relevant information to facilitate investigations.”

Meanwhile, administrative action has been initiated against Deputy Director of Petroleum Joseph Wafula, while the Kenya Pipeline Company has begun disciplinary proceedings against Supply and Logistics Manager Joel Mburu, who are alleged to have been involved in the irregular procurement.

Kenya takes global energy stage as EPRA DG Daniel Kiptoo named ICER vice chair

Kenya’s energy leadership goes global as Energy and Petroleum Regulatory Authority (EPRA) Director General Daniel Kiptoo Bargoria is appointed Vice Chair of the International Confederation of Energy Regulators (ICER).

This prestigious global role positions Kenya as a key global player in energy regulation, policy and innovation.

Speaking during the announcement, Kiptoo described the appointment as both a personal milestone and a recognition of Kenya’s growing credibility in energy reforms.

“This appointment is not just a personal milestone, but a testament to the strength and credibility of Kenya’s regulatory frameworks and the progress we have made as a country in energy reforms,” said Kiptoo. “It is also a powerful opportunity to bring Africa’s voice to the global regulatory table, championing sustainable and inclusive energy systems.”

ICER is a voluntary, not-for-profit framework that unites over 200 energy regulators worldwide. It fosters global dialogue, cooperation and the sharing of best practices to promote stable, sustainable and competitive energy markets.

The appointment adds to Kiptoo’s growing portfolio of appointments.

In July 2024, the EPRA DG was elected to head the 13-member Global Clean Energy Promoter Steering Committee of the Regulatory Energy Transition Accelerator (RETA) which brings together over 80 regulatory authorities globally with Africa being represented by Kenya, Cameroon, Democratic Republic of Congo, Egypt, Mauritius, Morocco, Rwanda and Sierra Leone.

Earlier in May 2024, he was re-elected as the Chairperson of the Regional Association of Energy Regulators for Eastern and Southern Africa (RAERESA). These concurrent roles position EPRA, and by extension, Kenya, as a regulatory leader across Africa and now, globally.

The appointment of the EPRA Director General as Vice Chair of ICER marks a significant milestone for Kenya’s energy sector, with far-reaching implications. It positions the country at the heart of global conversations on energy transition, digitalisation, resilience and innovation, enhancing Kenya’s role in shaping the future of energy.

The appointment also opens up new opportunities for knowledge exchange and capacity building, enabling EPRA and sector stakeholders to access global best practices, technical training and collaborative research.

This elevated status enhances investor confidence in Kenya’s energy landscape, particularly in renewable energy and infrastructure by reinforcing the credibility and stability of its regulatory environment.

Additionally, Kenya now has a more influential voice in international policy forums, allowing it to advocate for frameworks that align with Africa’s development priorities and sustainability ambitions.
