Botched plastic surgery: Owners of city clinic to be charged with manslaughter

The proprietors of a beauty clinic and a surgeon linked to the death of a businesswoman following a botched surgery last year in Lavington, Nairobi, are set to face manslaughter charges.

The Office of the Director of Public Prosecutions has approved the charges against Robert Maweu Mutula, a surgeon, George Wakaria Njoroge, and Lilian Edna Wanjiru of Body by Design operated by Omnicare Medical Limited located on Kabarsiran Avenue in Nairobi County.

This follows the death of 47-year-old Lucy Wambui Kamau on October 26, 2024, due to complications just days after undergoing cosmetic surgery at the facility.

The accused were initially scheduled to take their plea on Tuesday, April 1, but missed the court appearance, prompting the court to reschedule the hearing for tomorrow, Wednesday. Their lawyer stated that the suspects had been granted anticipatory bail by the High Court.

Kibera Senior Principal Magistrate Samson Temu directed the suspects to appear in court by 9:00 a.m.

The Ministry of Health and the Kenya Medical Practitioners and Dentists Council ordered the closure of the clinic due to several violations, including unlawfully operating a health institution without the necessary license, failing to meet required medical standards, and not adhering to patient safety regulations.

The decision was informed by a nationwide assessment of clinics offering plastic surgery procedures by the government.

Ominicare Medical shut down for non-compliance following fatal surgery

Ominicare Medical Limited, operating as “Body by Design” in Nairobi, has been shut down by the State Department for Public Health and Professional Standards following the tragic death of Lucy Wambui after a plastic surgery procedure at the facility.

Principal Secretary Mary Muthoni said the closure was prompted by a Kenya Medical Practitioners and Dentists Council (KMPDC) investigation, which revealed serious non-compliance with medical regulations under Sections 4 and 15 of the Medical Practitioners and Dentists Act (Cap 253).

According to Muthoni, the facility was operating below the required medical standards and failed to meet essential patient safety regulations, endangering the health and well-being of its patients.

The department emphasized that the immediate closure is necessary to protect public safety, pending corrective measures to bring the facility into compliance with patient safety standards.

Muthoni added that an in-depth investigation is currently underway into both the institution and the medical staff involved in Wambui’s treatment, with a focus on determining culpability and preventing future incidents of malpractice.

PS Muthoni reaffirmed the State Department’s commitment to maintaining high healthcare standards across Kenya, adding that further updates on the investigation would be shared as they become available.
