Kericho Governor Erick Mutai survives impeachment for second time

Kericho Governor Erick Mutai once again survived an impeachment bid after 26 Senators voted that the threshold to impeach him was not met by the County Assembly.

The motion was moved by Kakamega Senator Boni Khalwale, who questioned whether the required number of Members of the County Assembly (MCAs) had supported the impeachment. It was seconded by Narok Senator Ledama Ole Kina.

Following lengthy deliberations that extended into the night, the Senate concluded that the necessary threshold had not been met, paving the way for a final vote in which 26 Senators rejected the motion, 16 voted in support, and one abstained.

Senator Aaron Cheruiyot supported the motion on the impeachment, citing ICT experts who confirmed that 33 MCAs voted, thus meeting the threshold of 32.

Senate Speaker Amason Kingi subsequently terminated the impeachment proceedings, stating that the Senate had no mandate to conduct a trial if the County Assembly had not met the required threshold.

“The result of the division indicates that the motion has been negative and consequently the impeachment hearing hereby terminates,” ruled Kingi.

The impeachment motion had cited three charges against Governor Mutai: violation of the Constitution and other laws, abuse of office, and gross misconduct.
