Cohen murder case: Sarah Wairimu Cohen to remain in custody

Kibera High Court has denied Sarah Wairimu Kamotho bond for the second time after the prosecution opposed the renewed application for bail.

The court, through Lady Justice Diana Mochache, ruled that Wairimu, charged with the murder of Dutch tycoon Tob Cohen, would remain in custody at Langata Women’s Prison until the defence demonstrates a change of circumstances to warrant a review of the bail decision.

The prosecution, led by Ag. Deputy Director of Public Prosecutions Mr. Vincent Monda, had opposed her bond review application, citing her intimidation of prosecution witnesses, being a flight risk, and tampering with the crime scene.

The court found a likelihood of witness interference and flight risk, as Sarah had fraudulently obtained a second passport while the first was in police custody.

The court found that there had not been a sufficient change of circumstances to warrant a review of the bail decision.

The court emphasised the importance of protecting witnesses and the integrity of the criminal justice system.

Moreover, the court allowed a visit to the crime scene by the defence team, but under strict conditions to protect evidence.

She is alleged to have murdered her husband on the 19th of July 2019 in the Lower Kabete area within Nairobi County.

The matter will be mentioned on 30th July 2025 for directions.
